SB24-061: Colorado Drug Donation Program

• Creates the Colorado Drug Donation Program to facilitate safe donation and redistribution of unused prescription drugs, over-the-counter medications, FDA-approved investigational drugs, and medical devices to eligible patients.

• Defines eligible patients as Colorado residents who are indigent, uninsured, underinsured, or enrolled in public health benefits programs; eligible patients cannot be charged for medicine except for handling, dispensing, or customary charges.

• Allows donors (individuals, manufacturers, pharmacies, clinics, hospitals, government agencies) to donate medicines to donation recipients (wholesalers, hospitals, pharmacies, clinics, health-care providers), which may repackage, transfer, or replenish donated medicines.

• Establishes requirements for medicine quality and safety, including unopened tamper-evident packaging, no adulteration or misbranding, non-controlled substances, proper storage, and inspection by licensed pharmacists before dispensing.

• Provides civil and criminal immunity for donors, donation recipients, board members, and associated individuals acting in good faith without negligence or willful misconduct; requires State Board of Pharmacy to promulgate implementation rules.
