• Prohibits drivers from using handheld mobile electronic devices while operating motor vehicles, effective January 1, 2025, with exceptions for emergencies, public safety contacts, and first responders.

• Establishes tiered penalties: $75 fine plus $10 surcharge for first offense within 24 months; $150 plus $10 for second offense; $250 plus $10 for third or subsequent offense within 24 months.

• Allows dismissal of charges if defendant produces proof of hands-free accessory purchase and affirms under penalty of perjury they have not previously had a charge dismissed under this provision.

• Creates Class 1 misdemeanor traffic offenses with enhanced penalties if device use causes bodily injury or death to another person.

• Requires law enforcement to have witnessed device use causing careless and imprudent driving before citing violations, and appropriates $6,900 to the Division of Motor Vehicles for system implementation.
