Current law limits noneconomic damages in medical malpractice actions to $300,000; this bill increases the cap incrementally to $500,000 over 5 years beginning January 1, 2025.

Effective January 1, 2025, the limit increases to $340,000; subsequent annual increases occur each January 1st through 2029 ($380,000 in 2026, $420,000 in 2027, $460,000 in 2028, and $500,000 in 2029).

Each increased amount applies only to acts or omissions occurring on or after the effective date of that year's increase.

The General Assembly declares that updating monetary limitations on damages for noneconomic loss serves the purpose and intent of the "Health Care Availability Act."

Includes a safety clause finding the act necessary for immediate preservation of public peace, health, or safety and appropriations for state departments and institutions.
