CO SB145

Enacts the "Uniform Unlawful Restrictions in Land Records Act" as Article 36.5 of Title 38, Colorado Revised Statutes, establishing procedures to remove discriminatory and unlawful restrictions from property records.

Allows individual property owners to file amendments removing unlawful restrictions affecting only their property, and allows associations of owners to amend governing instruments to remove unlawful restrictions without requiring a member vote.

Defines "unlawful restriction" as any prohibition, restriction, covenant, or condition based on race, color, religion, national origin, sex, familial status, disability, or other personal characteristics, or in violation of Colorado or federal fair housing law.

Requires amendments to be executed, acknowledged, and recorded in the same manner as other land documents, with specific forms and conspicuous statements indicating the removal does not affect validity of non-unlawful restrictions.

Protects county recorders from liability for recording amendments, failing to record them, or inaccuracies in cross-referencing amendments to the original documents.
