Local governments that opt in may require permit applications for fencing projects on Sangre de Cristo Land Grant lands (granted by Mexico in 1844) starting July 1, 2025

Covered projects include contiguous fences at least 5 feet tall that either enclose a space and are 1+ mile long, or don't enclose a space and are 0.5+ mile long

Applications must be published within 14 days and decided within 60 days, with approval criteria including rational purpose, impacts on hunters' rights, floodplains, and aesthetic value

Approved fences must include wildlife passage openings: at least 20 feet wide with maximum 42-inch height every quarter mile for large mammals, and 5 feet wide with minimum 16-inch ground clearance every tenth mile for small mammals

Exemptions apply to public utility projects, Department of Transportation projects, public school and prison security fencing, and Division of Parks and Wildlife fences
