HB 25-1040: Adding Nuclear Energy as a Clean Energy Resource

• Adds nuclear energy, including projects funded through the U.S. Department of Energy's Advanced Nuclear Reactor Programs, to Colorado's statutory definitions of "clean energy" and "clean energy resource"

• Excludes nuclear energy from the definition of "clean energy resource" for purposes of property taxation

• Colorado's electricity peak demand is projected to double in the next 5 years; nuclear energy has a 92.7% capacity factor, the highest of all generation sources

• Small modular reactor development can create up to 900 construction jobs lasting up to 4 years and up to 300 permanent jobs

• Takes effect 90 days after legislative adjournment, unless a referendum petition is filed, in which case it would go to voters in November 2026
