Landowners who allow access to their property for entry and exit during emergencies are granted immunity from civil liability for damage or injury, provided they act in good faith and without compensation.

Covered emergencies include fires, rescue calls, hazardous materials incidents, natural or human-caused disasters (earthquakes, wildfires, floods, severe weather), and incidents determined to be emergencies by first responders.

Immunity does not apply to acts or omissions that are grossly negligent or willful and wanton.

Allowing emergency access does not guarantee the property is maintained or passable, does not authorize trespass, and does not impose any duty on landowners to maintain their property in a specific condition.

Takes effect 90 days after final adjournment of the general assembly and applies to property access granted on or after that date.
