HB 25-1072: Pretrial Release for Repeat Violent Offenses

• Prohibits courts from releasing a person on unsecured personal recognizance bond without district attorney consent if the person is accused of a crime of violence and has either a violent crime conviction within the prior 2 years or 2+ pending violent crime charges

• Establishes a minimum $7,500 monetary bond requirement for defendants accused of violent crimes who meet the repeat violent offender criteria

• Requires courts to find probable cause based on the arrest affidavit before applying the enhanced bond restrictions

• Applies only to offenses committed on or after the effective date, which is 90 days after final adjournment of the general assembly (subject to referendum petition)
