Rental agreement clauses requiring liquidated damages, repayment of move-in concessions, or other fees/penalties due to early termination caused by a tenant's death are void and unenforceable

Landlords cannot accelerate rent beyond the end of the month or more than 10 business days after the unit is vacated following notice of the tenant's death, whichever is later

Landlords may take possession without filing eviction if the estate's personal representative surrenders the premises, or if 30 days after the tenant's death rent remains unpaid or substantially all property has been removed

Landlords may retain security deposits to cover damage to the property caused by the tenant's death

Effective September 1, 2025, applying to rental agreements entered into on or after that date
