HB 25-1110: Railroad Crossing Maintenance Costs

• Colorado Public Utilities Commission must adopt rules requiring railroad crossing maintenance costs be split 50/50 between railroads and non-local government road authorities, covering materials, labor, traffic control, flagging, and permits.

• For local government road authorities, costs are divided geographically: railroads maintain the portion between railroad ties, while local governments maintain the portions outside the ties.

• "Maintain" covers preservation and upkeep of existing crossings but excludes installation, reconstruction, or operation of automatic safety signals and devices.

• Applies to both highway-rail crossings and pathway crossings, affecting railroads, rail fixed guideways, and transit agencies.

• Takes effect 90 days after legislative adjournment and applies only to costs accrued after the effective date, unless covered by a pre-existing cost-sharing agreement.
