PERA members or retirees convicted of sex crimes (including sexual assault, sexual assault on a child, human trafficking of a minor for sexual servitude, and child exploitation offenses) must forfeit all retirement benefits after exhausting appellate review, effective January 1, 2026

Forfeited benefits are transferred to a newly created Sexual Assault Survivors' Cash Fund in the state treasury

The Department of Corrections will administer a Sexual Assault Survivors' Restitution Grant Program to provide grants to sex crime survivors for medical and mental health resources

District courts must protect innocent parties by providing adequate notice and hearings before ordering forfeiture, and cannot forfeit benefits to which a spouse or former spouse is legally entitled

Convicted members also lose the option to receive a refund of their own contributions and matching employer contributions
