Local education providers using federal Infrastructure Investment and Jobs Act funds for HVAC improvements must follow specified assessment, repair, and verification procedures conducted by certified contractors and qualified personnel

Schools must install MERV 13 or higher air filtration where feasible, verify ventilation rates meet International Mechanical Code minimums, and test economizers, demand control systems, and building pressurization

A licensed mechanical engineer must review the HVAC assessment report, determine necessary repairs/upgrades, recommend pathways for reducing NOx and greenhouse gas emissions, and provide cost estimates

Contractors performing HVAC work must be on the Department of Labor and Employment's certified contractor list or use prevailing wages and registered apprentices, with waivers available only when no eligible subcontractors are available

HVAC verification reports must be completed within 10 business days of project completion and retained by the school for at least 5 years; the requirements apply to school districts, BOCES, charter schools, institute charter schools, and the Colorado School for the Deaf and Blind
