CO HB1325

Adds a new definition of "eligible person" in the direct care worker statutes (C.R.S. 8-7.5-102) to mean persons eligible for services under specified home- and community-based service waiver programs administered by the Department of Health Care Policy and Financing

Removes outdated statutory cross-references to section 25.5-6-1101(4) throughout the direct care worker provisions and guardianship statutes, replacing them with references to the new consolidated definition

Updates the definition of "direct care services" to specify individual parts (3, 4, 6, 7, 9, 11, 12, 13, or 19) of article 6 of title 25.5, rather than the previous "parts 3 to 13" language

Preserves existing rights of eligible persons in consumer-directed care models to control their services, including hiring, firing, scheduling, and setting wages for direct care workers

Takes effect 90 days after the General Assembly adjourns, unless a referendum petition is filed, in which case it would go to voters in November 2026
