State and local government forms requesting race or ethnicity must include a category for Middle Eastern, North African, or South Asian, in addition to federal Office of Management and Budget categories

Applies to forms collecting population-level demographic data that is not individually identifiable

Exemption allowed when data is reported to the federal government and would be rejected for including these categories as primary demographics; in such cases, they must be included as subcategories

Covers all state departments, agencies, boards, commissions, higher education institutions, and local governments including counties, municipalities, and school districts

Takes effect September 1, 2026, and applies to forms provided to individuals on or after that date
