Municipally owned utilities are generally excluded from Colorado's unclaimed utility deposits program under Article 8.5, which otherwise applies to electric and gas utilities

Municipally owned utilities may voluntarily elect to participate by paying unclaimed deposits either into the state commission-designated fund or into a fund designated by the municipal utility's own governing body

Participating municipal utilities must define "unclaimed deposits" consistently with the existing statutory definition of "unclaimed moneys"

Cooperative electric associations continue to have opt-in participation by notifying the commission of their election to participate

Effective date is 90 days after final adjournment of the general assembly, unless a referendum petition is filed, in which case voter approval would be required at the November 2026 election
