Relocates the definition of "utility company betterment" from subsection (3)(c) to the general definitions section (1)(j.5) of Colorado Revised Statutes 38-5-109

"Utility company betterment" is defined as any upgrade to utility facilities being relocated that is not attributable to the road improvement project and is made solely for the benefit and at the election of the utility company

Clearance letters may allow utility company betterments at the utility company's expense, provided they do not materially delay the utility relocation

Effective 90 days after final adjournment of the general assembly, unless a referendum petition is filed, in which case voter approval at the November 2026 election would be required
