HB 26-1001: Housing Opportunities Made Easier (HOME) Act

• Local governments with populations over 2,000 must allow residential developments on qualifying properties of 5 acres or less through an administrative approval process, effective December 31, 2027

• Qualifying property owners include nonprofits with affordable housing history, public transit nonprofits, school districts, state colleges/universities, housing authorities, and transit districts

• Jurisdictions cannot deny construction based on height if structures are 3 stories/45 feet or less, or if they comply with the zoning district's height requirements

• Jurisdictions cannot apply more restrictive standards than those for similar housing regarding setbacks, parking, lot coverage, landscaping, or minimum dwelling units per acre

• Exempt parcels include those without domestic water/sewage systems, those with conservation easements, those in airport influence areas, and historic properties outside historic districts
