Summary of HB 26-1059: Cost Recovery Cash Fund Consolidation

• Creates a single Cost Recovery Cash Fund in the state treasury to consolidate money retained by the Department of Revenue for administrative costs of collecting various fees and charges

• Repeals three existing individual cost recovery funds effective July 1, 2027: the oil and gas production fees collection fund, the enterprise per ride fees fund, and the retail delivery fees fund

• Transfers all unexpended and unencumbered money remaining in the repealed funds on June 30, 2027 to the new consolidated Cost Recovery Cash Fund

• Covers administrative costs for collecting: prepaid wireless 911 charges (capped at 3% of collections), production fees for clean transit and wildlife/land remediation, enterprise per ride fees, and retail delivery fees

• Exempts the new Cost Recovery Cash Fund from statutory limits on uncommitted cash fund reserves, with an effective date of August 12, 2026
