Insurance carriers are prohibited from entering third-party network lease agreements to access dental providers' services and negotiated discounts without the provider's affirmative written consent, including signature

Carriers cannot cancel contracts with dental providers or refuse to contract with new providers solely because they decline to participate in third-party network arrangements

When providers consent to third-party access, carriers must provide written lists of all third parties with access, maintain updated lists on a website reviewed every 90 days, and give 30 days notice before new agreements or terminations take effect

Third parties must comply with all terms and fee schedules of the original carrier-provider contract and must identify the source of any contractual discount on payment remittances

Exemptions apply to state medical assistance programs (Medicaid, Children's Basic Health Plan) and to network sharing among carriers operating under the same brand licensee program
