Entities requiring background checks for non-employment-based educational opportunities (unpaid internships, volunteer roles, clinical placements, pre-apprenticeships) must accept an Individual Taxpayer Identification Number (ITIN) as an alternative to a Social Security Number

Applies to state higher education institutions, local district colleges, 501(c)(3) nonprofits, volunteer organizations, licensed healthcare facilities, and K-12 schools

Exceptions allow SSN requirements when mandated by state/federal law, accreditation compliance, grant requirements, expense reimbursement processing, or financial account access

Civil penalties of $2,000 for first violation and $5,000 for subsequent violations, enforced by the Attorney General, with penalties credited to the Immigration Legal Defense Fund

Applies to contracts entered into and background checks requested on or after the effective date of the act
