Summary of HB 26-1195: Psychotherapy Artificial Intelligence Restrictions

• Prohibits AI systems from directly interacting with clients in therapeutic communication, generating treatment plans without licensed professional review, or detecting emotions/mental states in psychotherapy settings

• Requires written, informed consent from clients before AI systems can record or transcribe therapeutic sessions, with clients able to revoke consent without losing access to services

• Permits licensed psychotherapy professionals to use AI for administrative tasks (scheduling, billing, insurance claims) and supplementary support (therapy notes, anonymized data analysis) while maintaining full responsibility for all AI outputs

• Exempts AI use in accredited educational/training programs and federally-overseen research settings, as well as self-help apps that clearly disclose they do not substitute for clinical care

• Creates an unfair trade practice violation under the Colorado Consumer Protection Act for AI systems that falsely imply equivalence to licensed psychotherapy services or misrepresent user data confidentiality
