Private sector employers with 100 or more workers must include EEO-1 demographic workforce data in periodic reports filed with the Colorado Secretary of State

EEO-1 data includes employee categorization by race, ethnicity, gender, and job category as collected through the federal Employer Information Report

Exempts state government, local governments, federal government, school districts, state higher education institutions, and quasi-governmental entities from the reporting requirement

Takes effect July 1, 2027, subject to potential referendum petition requiring voter approval in November 2026
