HB26-1225: Advancing Grid Resilience Using Distributed Energy Resources Act

• Starting July 1, 2026, community solar garden fixed bill credits must be annually adjusted to reflect changes in the utility's total aggregate retail rate, protecting subscriber value against rising costs

• Public utilities cannot require interconnection customers to pay facility and upgrade costs until 30 days before the utility incurs those costs, though utilities may require security (surety bond or letter of credit) at the time of agreement execution

• By July 1, 2026, public utilities must allow interconnection customers to hire third parties to perform interconnection studies, with utilities required to respond to such requests within 15 days

• By September 1, 2026, utilities must enable concurrent performance of all required interconnection studies rather than sequential processing

• By October 1, 2026, utilities must allow customers to contract with third parties for interconnection upgrades including engineering, procurement, and construction, with utilities required to respond to upgrade plans within 30 days
