Remote psychiatric inpatient facilities may operate under a main general hospital's license rather than obtaining a separate psychiatric hospital license, if they have federal provider-based status under 42 CFR 413.65

Qualifying remote locations must be standalone facilities within 35 miles of the main hospital in a rural area, offer primarily inpatient psychiatric services with 17 or more beds, and meet all State Board of Health psychiatric hospital licensing rules

Remote psychiatric inpatient locations must be designated by the Behavioral Health Administration Commissioner, certified to accept Medicaid, and accredited by a psychiatric hospital accrediting organization

Enforcement actions by the Department are taken against the main hospital's general license, regardless of whether violations occur at the main hospital or remote psychiatric location

Main hospitals must pay a separate licensing fee for each remote psychiatric inpatient location operating under their general hospital license
