Covenants or declarations recorded on or after January 1, 2027 that require residential property owners to join and pay for membership in a private membership club are void and unenforceable

Private membership clubs collecting dues from property owners under existing covenants must annually disclose budget information, financial statements, assessments, insurance policies, bylaws, and meeting minutes within 90 days of fiscal year end

Disclosures must be posted on the club's public website and mailed or delivered to property owners at no cost

Clubs that fail to comply with disclosure requirements have their membership covenants rendered void and unenforceable until compliance is achieved

Property owners may bring civil claims against non-compliant clubs and may be awarded actual damages, punitive damages, and attorney fees if they prevail
