SB26-027: Parental Equality and Child Empowerment Act (PEACE Act)

• Creates a rebuttable presumption that equal parenting time between both parents is in the child's best interests when both parents live within 25 miles of the child's school, child care, or other court-determined reasonable location

• Defines "equal parenting time" as at least 45% of overnight visitations at each parent's residence annually, with adjustments allowed for school schedules, holidays, and logistics

• Allows the presumption to be rebutted by clear and convincing evidence, including: child abuse or domestic violence convictions, substance/alcohol misuse, mental health disorders impairing parenting fitness, refusal to share parenting responsibilities, or significant geographic barriers

• Requires courts to make specific written findings of fact when ruling on motions to rebut the presumption, documenting the clear and convincing evidence relied upon

• Applies to all proceedings filed on or after the effective date and pending proceedings without a final order
