State agencies disclosing information to the State Auditor, Legislative Audit Committee, or Governor during fraud hotline investigations do not waive legal privileges simply by making that disclosure

Protected privileges include attorney-client privilege, attorney work product confidentiality, common interest privilege, deliberative process privilege, and exemptions from public disclosure under state or federal rules

"Information or materials" is defined broadly to include any writing prepared or maintained by a state agency, as well as verbal responses to State Auditor inquiries related to an investigation

Effective date is August 12, 2026, unless a referendum petition is filed, in which case voter approval would be required at the November 2026 general election
