Counties may use money from the community impact cash fund, air quality enterprise cash fund, and local government mineral impact fund to comply with landfill methane emission reduction requirements adopted by the Air Quality Control Commission.

The air quality enterprise board must conduct and publish research on best practices for reducing landfill methane emissions by December 31, 2028, including funding opportunities and cost-offset strategies for counties.

Compliance schedules for local government landfill permits must consider existing debt service and financial capability, with the division allowed to establish schedules exceeding 20 years where federal law permits.

Landfills reaching or exceeding methane emission limits on or after the bill's effective date receive a 2-year grace period before methane reduction requirements apply.

Local governments are exempt from noncompliance penalties for failing to meet landfill methane emission rules if they demonstrate the failure is due solely to financial inability to comply.
