HB 5120 / PA 10-87 Summary

• Expands recycling regulations effective October 1, 2010 to include containers of three gallons or less made of polyethylene terephthalate and high-density polyethylene plastic, and additional paper types including boxboard and magazines, with implementation deadline of October 1, 2011

• Requires municipalities to offer curbside or backyard collection of designated recyclable items to residential and business customers by July 1, 2011, with exemptions for municipalities exceeding the statewide recycling average

• Mandates private waste collectors to offer curbside or backyard collection of designated recyclable items and include it in solid waste collection charges by July 1, 2011, with the same exemptions as municipalities

• Prohibits zoning regulations from restricting recycling receptacles for businesses or residential properties, except for screening or buffering for aesthetic reasons, and allows conversion of existing trash receptacles by labeling

• Requires waste collectors to register annually with municipalities, report waste destinations and amounts, and disclose information about solid waste and recyclable materials delivered to out-of-state destinations or in-state end users, effective July 1, 2010 through July 1, 2011
