HB 5196 Summary

• Commissioner of Children and Families must request free annual credit reports for all youth age 16 and older in foster care custody, with first request due within 15 days of turning 16 or by July 31, 2010 for those already in care.

• Commissioner or designee must review each credit report for evidence of identity theft and report findings to the office of the Chief State's Attorney within 5 business days if identity theft is discovered.

• Commissioner must advise the youth, foster parent, caseworker, and legal representative of any identity theft findings when reviewing the youth's care plan pursuant to state law.

• Commissioner must report to the joint standing committees on human services and appropriations by July 1, 2011 regarding any identity theft findings discovered in foster youth credit reports.
