Establishes implied warranty of merchantability for retail consumer goods sales, requiring goods to pass trade standards, be fit for ordinary use, and conform to container or label representations.

Makes unenforceable any language by retail sellers attempting to exclude or modify implied warranties of merchantability and fitness or consumer remedies for breach of those warranties.

Requires sellers to replace non-merchantable goods with substantially similar new goods upon consumer return under the seller's return policy, prohibiting substitution of refurbished goods unless the original purchase was refurbished or consumer agrees.

Makes unenforceable any contract provision allowing replacement of new goods with refurbished goods without consumer consent.

Effective October 1, 2010.
