Establishes separate reimbursement rates for emergency room physicians who provide services to Medicaid beneficiaries and do not receive a salary or subsidy from the hospital.

Requires the commissioner to adopt regulations defining emergency and nonemergency visits to hospital emergency rooms, with nonemergency visits paid at the hospital's outpatient clinic services rate.

Prohibits state payments to hospitals for emergency room services that exceed the charges made by the hospital for comparable services to the general public.

Takes effect July 1, 2010.
