Commissioner of Social Services shall work with Commissioner of Public Health to meet qualification criteria under Section 4201 of the American Recovery and Reinvestment Act of 2009 to obtain matching funds and incentive payments for hospitals and eligible professionals using electronic health records.

Commissioner of Social Services must disburse any received federal incentive funds to hospitals and eligible professionals within five business days of receipt.

Department of Public Health shall seek private and federal funds for initial development of a state-wide health information exchange and establishment of health information technology pilot programs.

Department of Public Health shall facilitate implementation of a health information technology plan to create an integrated state-wide electronic health information infrastructure for sharing health information among health care facilities, professionals, payors, and patients.

Department of Public Health must develop privacy standards and protocols for electronic health information sharing that comply with Health Insurance Portability and Accountability Act requirements, including security measures and electronic audit trails for access tracking.
