Adds a new category to sexual assault in the second degree (class C felony, or class B if victim under 16) making it illegal for someone with supervisory or disciplinary authority over a person placed or treated under the Commissioner of Developmental Services to engage in sexual intercourse with that person.

Adds a new category to sexual assault in the fourth degree (class A misdemeanor, or class D felony if victim under 16) making it illegal for someone with supervisory or disciplinary authority over a person placed or treated under the Commissioner of Developmental Services to subject that person to sexual contact.

Applies to persons in any public or private facility or program under the Commissioner of Developmental Services direction.

Sentencing requires a minimum of nine months imprisonment that cannot be suspended or reduced for second degree sexual assault convictions.

Effective October 1, 2010.
