Reorganizes the Advisory Council for Special Education effective July 1, 2010, reducing total membership and reallocating appointment authority among the Commissioner of Education, state agency heads, legislative leaders, and the Governor

Requires appointments to the council to represent the ethnic and racial diversity and types of disabilities found in the state population

Mandates that local and regional boards of education provide applied behavior analysis services to children with autism spectrum disorder if required by their individualized education plan or Section 504 plan, effective July 1, 2012

Allows applied behavior analysis services to be provided by licensed/certified professionals, behavior analysts certified by the Behavior Analyst Certification Board, or supervised teachers and paraprofessionals

Permits the Commissioner of Education to authorize services by bachelor's degree holders with specific coursework when insufficient certified personnel are available, provided they work under supervision of a board certified behavior analyst
