Creates new class A misdemeanor offense of "misconduct with a motor vehicle in the second degree" for causing serious physical injury to vulnerable users through criminally negligent operation of a motor vehicle, effective October 1, 2010

Defines "vulnerable users" as pedestrians, highway workers, people riding animals, bicyclists, wheelchair users, people using skateboards or roller skates, and operators/riders of agricultural tractors without enclosed compartments

Defines "public way" as highways, shoulders, sidewalks, parking areas, or multi-use trails

Requires sentencing to include imprisonment (with execution suspended entirely or partially), probation with mandatory attendance at a motor vehicle operator's retraining program, and up to 100 hours of community service

Amends existing misconduct with a motor vehicle statute to designate it as "first degree" (class D felony) when a motor vehicle operation with criminal negligence causes death
