HB 5527 Summary

• Allows service of process on limited liability companies to be made upon members or managers when the statutory agent cannot be found, in addition to service through the Secretary of the State.

• Expands the authority of state marshals to serve process outside their precinct when serving the Secretary of the State, Commissioner of Motor Vehicles, Attorney General, or Insurance Commissioner.

• Permits state marshals of any precinct to serve persons confined in correctional institutions or community correctional centers throughout the state.

• Changes the statute of limitations for civil actions against sheriffs, state marshals, or constables from an unspecified period to two years after the right of action accrues.

• Allows a cause of action to be preserved if process is delivered to a state marshal, constable, or other proper officer within the filing deadline, with service completed within 30 days of delivery.
