Contracting entities entering into or renewing health care provider contracts on or after January 1, 2009 must include explicit provisions stating they may sell, lease, rent, assign or grant access to the provider's services, discounted rates, or fees.

Contracting entities must maintain a website or toll-free number listing all covered entities with access to a provider's services and update this listing at least every 90 days.

Covered entities that subsequently sell, lease, rent, assign or grant access to provider services must maintain their own website or toll-free number and inform the original contracting entity and health care providers of this contact information.

All remittance advices must clearly identify both the covered entity responsible for payment and the contracting entity through which the payment rate and discounts are claimed.

Violations of these requirements are deemed unfair or deceptive insurance practices; the Insurance Commissioner may adopt regulations to enforce these provisions and nothing prohibits health care providers from filing claims or actions against contracting or covered entities.
