Repeals and replaces Section 7-278 of the general statutes regarding dismissal of police department heads and officers, effective October 1, 2010.

Prohibits dismissal of active police department heads and officers not subject to collective bargaining agreements unless just cause is demonstrated by the dismissing authority.

Requires the dismissing authority to provide written notice of specific grounds for dismissal and hold a public hearing not less than five nor more than ten days after notice is given.

Allows dismissed officers to appeal to superior court within thirty days, with the court authorized to affirm the dismissal or set it aside if the authority acted illegally, arbitrarily, with bad faith, malice, or without just cause.

Permits superior court to review the hearing record, take additional evidence if necessary through a referee or committee, and make a determination based on findings of fact.
