Reduces the delivery threshold for assessing surcharges on fuel oil and propane from one hundred to ninety-nine gallons, effective July 1, 2010.

Prohibits retail dealers from assessing surcharges on deliveries exceeding the new threshold, except when delivery occurs outside normal service area, outside normal business hours, or involves extraordinary labor costs.

Bans residential customer minimum delivery surcharges on all seller-initiated deliveries, including those under automatic delivery agreements.

Establishes penalties for violations: up to $500 for first offense, $750 for second offense within three years, and $1,500 for third or subsequent offense within three years.
