Adds a new ground for patient discharge from facilities: failure to pay applied income determined by the Department of Social Services for medical assistance recipients for more than 60 days, subject to federal law restrictions.

Restructures existing discharge grounds (patient welfare, improved health, facility safety, nonpayment arrearage, facility closure) into a numbered list format while maintaining their substance.

Requires facilities to provide patients who apply for medical assistance with a written estimate of their applied income amount and written notice that failure to pay may result in discharge.

Applies to continuing care facilities that guarantee life care, allowing discharge of self-pay residents who intentionally transferred assets to avoid paying facility costs.

Effective date: October 1, 2010.
