Senate Bill 250 - Revised Uniform Anatomical Gift Act

• Enacts the Revised Uniform Anatomical Gift Act effective October 1, 2010, establishing comprehensive procedures for anatomical gifts (organ, tissue, and eye donations) for transplantation, therapy, research, or education.

• Allows adults and emancipated minors to make anatomical gifts through donor registry enrollment, donor cards, wills, or other signed documents; permits agents and parents of unemancipated minors to make gifts on behalf of donors.

• Establishes a priority order for family members and others to make anatomical gifts on behalf of deceased persons who did not make prior donations, with requirements for majority consent when multiple family members exist at the same priority level.

• Requires hospitals to enter agreements with procurement organizations and mandates law enforcement, firefighters, and hospitals to search for donor documents or refusals; allows procurement organizations to access Department of Motor Vehicles records to verify donor status.

• Classifies unlawful organ sales and fraudulent falsification of donation documents as Class A misdemeanors; provides liability protection for persons acting in good faith compliance with anatomical gift laws.
