Modifies the Commissioner of Transportation's authority to issue orders for removing, relocating, or altering dangerous railroad crossings at grade, with cost apportionment among affected parties (public service companies, municipalities, and the state).

Requires the Commissioner of Transportation to submit a comprehensive report to relevant legislative committees by October 1, 2009, and every three years thereafter, listing all at-grade rail crossings, identifying hazardous ones, and providing budget and prioritization recommendations.

Establishes a program requiring the Commissioner to implement upgrades or elimination of hazardous at-grade railroad crossings identified in submitted reports, apply for available federal funding, and set aside five percent of Fix-it-First program funds for state road crossings.

Effective date of October 1, 2010 for changes to General Statutes Section 13b-276.
