Requires state quasi-public agencies operating waste-to-energy facilities to obtain written determination from the Commissioner of Environmental Protection before physically inspecting or evaluating land for ash residue disposal areas.

Commissioner must determine that the proposed disposal area is necessary to meet the state's solid waste disposal needs and will not create substantial excess capacity of disposal areas.

Waste-to-energy facilities seeking approval must submit information including the names of facilities or municipalities to be served, required transportation systems, and available capacity of other permitted ash residue or mixed municipal solid waste disposal areas in the state.

Commissioner must consider all submitted information and any other pertinent information when making the necessity determination.

Effective upon passage, with approval date of May 28, 2010.
