• Prohibits drivers from using hand-held mobile telephones to engage in calls or using mobile electronic devices while operating a motor vehicle in motion, effective October 1, 2010

• Bans texting with hand-held mobile telephones or mobile electronic devices while a vehicle is in motion

• Exempts emergency communications, peace officers and firefighters performing official duties, and hands-free mobile telephones from the prohibition

• Establishes escalating fines: $100 for first violation, $150 for second violation, and $200 for third or subsequent violations of hand-held phone use

• Prohibits drivers under 18 years of age from using any hand-held mobile telephone or mobile electronic device while operating a moving motor vehicle, with limited emergency exceptions

• Requires municipalities to remit 25 percent of fine revenue from violations to the state, with quarterly reporting to the Comptroller
