Bill Summary: SB 449

• Permits courts to order continuation of child support obligations for parents whose parental rights were terminated due to sexual abuse, provided the parent was convicted of a crime involving sexual abuse of the child and continuation is determined to be in the child's best interests; such obligations terminate upon adoption of the child.

• Requires courts and family support magistrates to schedule annual hearings to review all child support orders until expiration, with notice provided to obligor, obligee, and interested parties; courts may modify orders upon showing substantial change in circumstances or substantial deviation from child support guidelines.

• Changes the frequency of child support order reviews from every three years to every year for requesting parties without needing to prove substantial change in circumstances.

• Mandates that courts provide notice to parents whose parental rights are being terminated due to sexual abuse that their child support obligation may continue upon motion of the other parent.

• Establishes a task force to study child support enforcement mechanisms in other states and their effectiveness, with report due by January 1, 2011.
