Requires bail commissioners to assess reoffending risk and consider releasing arrested nonviolent offenders to home confinement with GPS monitoring instead of incarceration, effective October 1, 2010.

Directs probation officers to assess reoffending risk and recommend to courts that convicted nonviolent offenders receive probation with home confinement and GPS monitoring as an alternative to incarceration.

Requires supervising officers to assess reoffending risk and recommend home confinement with GPS monitoring for probationers or parolees arrested for nonviolent crimes during violation or revocation hearings.

Applies only to crimes that do not involve use, attempted use, or threatened use of physical force against another person.
