Reclassifies possession or use of drug paraphernalia from a class C misdemeanor to an infraction, effective October 1, 2010.

Creates a new infraction for possession of less than one ounce of cannabis-type substance, effective October 1, 2010.

Modifies penalties for possession of controlled substances other than narcotics or hallucinogens: possession of one ounce or more but less than four ounces of cannabis is punishable by up to $1,000 fine or one year imprisonment for a first offense, and up to $3,000 fine or five years imprisonment for subsequent offenses.

Stated purpose is to reduce state costs by reclassifying minor drug possession offenses from misdemeanors to infractions.
