The Commissioner of Developmental Services, in consultation with the Commissioner of Agriculture, may grant an agricultural conservation easement to a nonprofit organization (501(c)(3) status) on land at the Southbury Training School in Southbury and Roxbury.

The easement allows the nonprofit to preserve the land for agricultural use and lease portions to individuals or entities engaged in agriculture.

The easement size shall be determined by recommendations from the Farmland Preservation Advisory Board per special act 09-8 and requires State Properties Review Board approval.

If the nonprofit fails to use the easement for agricultural preservation purposes or does not retain ownership of the entire easement, it automatically reverts to the state.

The state retains rights to access the easement land, maintain existing and future utilities (electrical, water, sewer, telecommunications, gas), and enforce governmental obligations.
