Establishes a rebuttable presumption that holding a cigarette, cigar, pipe, or similar device to or near one's mouth while the vehicle is in motion or at rest constitutes smoking.

Classifies violations as infractions.

Aims to protect children from secondhand smoke exposure in vehicles.
